Terms of Sale
The following terms ("Terms of Sale") govern purchases made by any person (including consumers) on the Starke Lifestyle website, owned by Starke Connect Private Limited ("Starke Lifestyle," “Starke Connect Private Limited,” “SCPL,” "we," "us," "our"), available at starke-lifestyle.com (the "Website").
Please review these Terms of Sale carefully. By proceeding to place an order, you agree to be bound by all the Terms of Sale set forth herein. If you do not agree with these Terms of Sale, do not place an order on the Website.
A copy of these Terms of Sale may be downloaded, saved, and printed for your reference.
Ordering Process
Once the checkout process is completed on the Website, you will receive an automatic email confirming your order to the email address provided during the order. This email confirms that Starke Lifestyle has received your order. However, Starke Lifestyle reserves the right, at its sole discretion, to cancel or refuse any order for any reason. Once Starke Lifestyle receives payment and ships your order, a legally binding contract will be formed between you and Starke Lifestyle, consisting of your invoice and these Terms of Sale.
Some situations that may result in your order being cancelled or refused include:
- Limitations on quantities available for purchase.
- Inaccuracies or errors in product or pricing information.
We may also require additional verification or information before accepting any order. Starke Lifestyle will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your credit card has been charged, a credit will be issued in the amount of your charge to your credit card.
Prices and Currency
The prices displayed on the Website are shown in Indian Rupees, often denoted as INR, Rs., and/or ₹. Shipping and handling fees and taxes, if applicable, are listed. You are responsible for the payment of any shipping and handling charges and any taxes that may apply to your order. These charges are added to the invoice price during the order process.
Some orders may require the payment of import duties before the order can be delivered. These import duties are set at a governmental level and may vary from country to country. You are responsible for the payment of any applicable import duties on your order.
All amounts payable pursuant to the contract formed by the invoice and these Terms of Sale are in Indian Rupees (INR ₹).
Payment Method
You may pay for your purchase using NetBanking, Visa, MasterCard, American Express credit or debit cards, and various UPI payment methods via Google Pay, PayTm, BHIM, PhonePe, and more. You authorize Starke Lifestyle to charge the applicable payment method the amount of the invoice. You represent and warrant that you are the authorized cardholder of the applicable credit card or account holder of the corresponding payment method.
If your payment method is rejected by the corresponding payment handler, your order will not be shipped, and Starke Lifestyle will have no obligation to fulfill your order. All billing and registration information provided by you to Starke Lifestyle must be truthful and accurate. Providing any untruthful or inaccurate information constitutes a breach of these Terms of Sale.
Availability and Descriptions
The purchase of products on the Website is subject to their availability. If the product you request is not available at the time of your order, Starke Lifestyle will have no obligation to fulfill your order, and you will have no obligation to pay Starke Lifestyle for the order. While we strive to keep accurate product and pricing information on the Website, errors and/or omissions may occur. In the event that an item is listed at an incorrect price, information, or stock availability, Starke Lifestyle shall have the right, at its sole discretion, to refuse or cancel any orders placed for that item. If an item is incorrectly priced, we will notify you of such cancellation.
From time to time, the Website may be down or otherwise unavailable for maintenance, upgrades, or other purposes. Starke Lifestyle reserves the right to take the Website down or otherwise make any changes to the URL or content therein, without notice to you. Starke Lifestyle is not liable to you for anything (including losses, costs, fees, or expenses) in connection with the Website being unavailable.
Quantity Limits and Items for Resale
Starke Lifestyle reserves the right, at its sole discretion, to limit the quantity of items purchased per person, per household, or per order. These restrictions may apply to orders placed by the same account, the same payment method, and also to orders that use the same billing and/or shipping address. We will notify you should such limits be applied. Starke Lifestyle also reserves the right, at its sole discretion, to prohibit sales to dealers or re-sellers.
Title to Products
Once Starke Lifestyle receives payment for your order and the product(s) leave Starke Lifestyle’s facilities, the product(s) belong to you. In legal terms, all right, title, and interest in the product(s) included in your order transfer from Starke Lifestyle to you at that point.
Order Delivery
Your order will be shipped to the delivery address specified by you during the order process, via the method of delivery specified by you. Legally, all risk of loss or damage to the product(s) you ordered is with you once the product(s) leave Starke Lifestyle’s facilities. Starke Lifestyle is not responsible for any loss of the product(s) following shipment from Starke Lifestyle's facilities to your delivery address. However, Starke Lifestyle values customer satisfaction. If your order gets lost in transit, please get in touch using our Contact Form, and we will do our best to ensure you receive the items you paid for.
Cancellation / Returns
Orders may be cancelled until the moment they begin processing. Cancellations of any order will result in a full refund to your applicable payment method. Returns and/or exchanges can be made with the express authorization from a Starke Lifestyle representative. Refunds can be provided for products that are damaged before they are delivered to you. If you receive your order and any products appear to be damaged, please contact us promptly. Returns for unopened, unused merchandise may be eligible for a refund minus the shipping amount.
Undelivered Goods
If an order does not successfully arrive at the delivery address provided during checkout within the recommended timeframe specified in your Shipping Confirmation, please use the Contact Form to let us know. We'll get in touch to ensure that you receive the items you paid for. We do not provide refunds based on undelivered items, as delivery is out of our control once an item has left our warehouse. To reiterate, if your order has not been delivered within the specified timeframe in your Shipping Confirmation, please send us a message through our Contact Form. Under no circumstances does Starke Lifestyle provide refunds for undelivered goods which have been shipped to freight-forwarding addresses.
No Warranties on Cases / Covers
When you place an order, you buy the product(s) on an "as is" basis. To the maximum extent permitted by law, Starke Lifestyle disclaims all warranties with respect to its product(s), including any warranties of merchantability, non-infringement, and fitness for a particular purpose. Because some jurisdictions do not permit the exclusion of certain warranties, these exclusions may not apply to you. The warranty period on eligible items is applicable as provided by the respective brand from the date of purchase. Starke Lifestyle is not liable for any rejections in warranty claims by the brand.
Limitation of Liability
Starke Lifestyle’s liability under the contract formed by your invoice and these Terms of Sale shall be strictly limited to the total amount payable by you for the product(s) as set out in your invoice, excluding any applicable shipping fees, handling fees, customs duties, and taxes. Additionally, Starke Lifestyle’s liability shall be further limited to actual damages suffered. Under no circumstances is Starke Lifestyle liable for SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL LOSSES OR DAMAGES. This paragraph is intended to survive the termination, expiry, or performance of this contract.
Language
By placing an order and entering into this contract with Starke Lifestyle formed by the invoice plus these Terms of Sale, you agree that said agreement and all related documents are to be drafted in the English language. The agreement may be translated into another language, but in the event of any diversion between the English version and any other version, the English version shall prevail.
Governing Law
The contract formed by the invoice and these Terms of Sale will be governed by Indian laws, subject to Ahmedabad (Gujarat) jurisdiction.
General
These Terms of Sale constitute the entire agreement between you and Starke Lifestyle with respect to your purchase of products through the Website. If any provision of these Terms of Sale is held to be invalid or unenforceable, such provision will be severed from the Terms of Sale, and the remaining provisions shall remain in full force and effect. The delay or failure of Starke Lifestyle to act with respect to a breach by you or others of the contract created by these Terms of Sale does not constitute a waiver and shall not limit Starke Lifestyle's rights with respect to such breach or any subsequent breaches. All waivers shall be in writing.
Starke Lifestyle shall not be liable for any delay or failure to perform any of its obligations under these Terms of Sale if such delay or failure is due to causes beyond its control, such as, by way of example, snowstorms, ice-storms, flooding, hurricanes, and other inclement weather. You may not assign these Terms of Sale to any other person without the prior written consent of Starke Lifestyle. Starke Lifestyle may assign any of its rights hereunder to any other person or persons at any time without notice to you. These Terms of Sale will be binding upon and will ensure to the benefit of:
- (i) you and your heirs, executor, administrator, and other legal representatives; and
- (ii) Starke Lifestyle and its successors and assigns.
Notwithstanding any other provision of these Terms of Sale, any provision of these Terms of Sale that imposes or contemplates continuing rights or obligations on you or us will survive the expiration or termination of the contract formed by the Terms of Sale and the invoice.
Honest Performance
You and Starke Lifestyle hereby agree to perform the obligations herein honestly. A party shall not mislead or misrepresent to any other person any matter in connection with this contract, including the terms herein or any
